Theft Defence Charges
Before a person can be found guilty of a theft/dishonesty charge the court has to find that they were acting dishonestly. This therefore goes against the character of the individual concerned and could well affect further business/work/professional prospects. Theft by Finding
This can include the situation where a person walking down the street comes across an item of property, picks it up and keeps it. There are certain situations where property has clearly been discarded as rubbish. In that situation there would be no prosecution. There are other situations where the property clearly has not been thrown away because of its condition or value.
In that situation if a person picks up that item and keeps it as their own they may face a prosecution for theft by finding. Once again, usually the issue of dishonesty will be the main factor in the case. If the defence can satisfy the court that the person genuinely believed that the item had been discarded then the court may well find them not guilty of any offence.
Theft by Shoplifting
This is the situation where an individual has entered a store and left without paying for goods. There may be a number of reasons for this having taken place. There are situations where, for example a person genuinely believes that somebody else in their company has paid for the property or, most likely where they have been preoccupied or distracted and have simply forgotten or failed to pay for the property before leaving the store.
If the court believes that this was a genuine accident and there was no dishonesty on the part of the defendant then there will be no conviction for the theft charge.
