Trading Standards Used Vehicle Investigation

Common issues in used vehicle sales include illegal clocking, dealers pretending to be private sellers, the use of illegal disclaimers and failures to disclose sufficient information about vehicles prior to sale.

Under the Sale of Goods Act 1979 dealers are legally required to find out important information about a vehicles history before trading. Everything you say about the vehicle should be true, or even if true is not misleading in the way it is presented. The specific checks you will need to undertake will depend on the circumstances of each vehicle you intend to sell. Before exposing any vehicle for sale you are advised to take all reasonable steps to establish the accuracy of the stated mileage and any vehicle you offer for sale must be safe and roadworthy.

If the vehicle you sell is not of ‘satisfactory quality’, the customer is legally entitled to a number of remedies. You are not liable, however for the following circumstances

  • Fair wear and tear.
  • Misuse or accidental damage by the customer.
  • If you specifically draw to the customer’s attention the full extent of any fault or defect before they buy the vehicle.
  • If the customer examined the vehicle before buying it and should have noticed the fault.

Trading Standards Offence Penalties

As soon as any individual or corporate body becomes aware that they are the subject of a trading standards investigation or prosecution it is vital that they obtain immediate specialist legal advice.

Professional Defence Lawyers specialise in Trading Standards prosecutions, so contact us today to get the expert defence you need.

Proceeds of Crime

If an individual or company is found guilty of a trading standards offence then the court may consider an application under the Proceeds of Crime Act. The basic principle is that if anybody has benefited financially from any unlawful activity then the court has the power to try to assess the amount of that benefit and make an order that it be repaid.

At Professional Defence Lawyers we have extensive experience of dealing with applications under the Proceeds of Crime Act and are able to deal with any such application by any client facing a trading standards prosecution.
