Provisions of Use at Work Regulation Defence
We represented a manufacturing company who had a large factory with extensive machinery and conveyor belts. This company had exhaustive safety measures in place. An employee of the company whilst using a conveyor belt and in express breach of safety guidelines which had been put in place, attempted to clean the machine whilst it was still working. As a result the employees arm became trapped in the machine and he suffered serious injuries.
There was then an investigation by the Health and Safety Executive which resulted in our client being prosecuted under the Provisions of Use at Work Regulation 1988.
Successful Health & Safety Defence
We assisted our client throughout the investigation, at interview and represented the company in the court proceedings. The matter was denied and after a trial our client was found not guilty of the health and safety prosecution. The court accepted that this incident was caused by the actions of the worker and were not as a result of the breach of any safety regulation on the part of our client.
